Legal Issue of Sports Televising, IP Protection D...
Recently the "Symposium on the Legal Issue of Sports Televising" has been held in Yangpu. Among nearly 40 attendees were experts and professors from Shanghai University of Finance and Economics, Tongji University and other universities, as well as senior judges from Guangdong Higher People's Court, Beijing Higher People's Court and Shanghai's court system.


Compared to the rapid development of sports business, China remains deficient in the intellectual property research and protection of sports event programs. This is ascribable to legislative defects, and the academic division on the nature and protective modes of sports televising. Are sports event programs are film & television works or video recordings? Does sports webcasting fall into the category of the right of communication through information network? Is illegal use of sports event programs subject to the Copyright Law or the Law against Unfair Competition? These questions need to be answered.


Of the domestic existing cases of sports televising, some recognized sports event programs as works protected by the Copyright Law, some recognized sports event programs as video recordings protected by the Law against Unfair Competition, and some handled in accordance with the Law against Unfair Competition. The symposium aimed to reach clear consensus on the model of judicial protection of sports televising.


According to the Yangpu District People's Court, the symposium is a positive move of the court to serve the construction of "Great Wujiaochang" National Sports Industry Demonstration Base, which reflects the judicial function of promoting the healthy and orderly development of the sports televising industry. The legal issue of sports televising is a typical knotty legal problem arising in intellectual property trials, as well as a problem not covered in the existing legal system of intellectual property laws.
