Item: Divorce Registration of Shanghai Residents with Foreigners, Overseas Chinese and Residents of Hong Kong, Macau and Taiwan

Details:

1. Authority of Acceptance

Marriage (Adoption) Registry Office of Shanghai

2. Responsibility

1). Complete the marriage registration procedures for Shanghai residents with foreigners, overseas Chinese and residents of Hong Kong, Macau and Taiwan in accordance with law;

2). Promote the “Marriage Law of the People’s Republic of China” and advocate civilized marriage customs.

3. Legal Basis
“Marriage Law of the People’s Republic of China”
“Marriage Registration Regulations of the People’s Republic of China”

4. Conditions of Registration

1). Both parties must be willing to divorce;

2). Both parties must have reached a consensus on child support, assets and debts;

3). The couple’s marriage registry shall be made in Chinese mainland;

4). Both parties must have full capacity for civil conduct;

5). Both parties shall go through divorce formalities and receive divorce certificate in Marriage (Adoption) Registry Office of Shanghai;

5. Documents (original copies) that the applicants shall provide:

1) Shanghai residents

a. Household register and ID card;

b. Marriage certificate;

c. The “Consensual Divorce Agreement” with the signature of both parties;

Notes:

① The applicant’s marital status on the household register should be identical with his or her actual marital status. If not, the applicant shall go to the police station and have his or her marital status changed;

② If the applicant has a collective registered residence, he or she shall bring his or her own registered page or its copies, with the seal of the authority being attached;

③ If the applicant can not provide a household register, he or she shall provide a valid resident certification issued by the police station where his or her registered permanent residence located in;

④ If the applicant can not provide a valid ID card, he or she shall provide a valid temporary ID card;

2) Residents of Hong Kong, Macau and Taiwan

a. Valid ID cards and “Mainland Travel Permit for Hong Kong and Macau Residents”;

b. Marriage certificate;

c. The “Consensual Divorce Agreement” with the signature of both parties;

3) Overseas Chinese and Foreigners

a. Valid passport or other valid international travel documents;

b. Marriage certificate;

c. The “Consensual Divorce Agreement” with the signature of both parties;

Notes:

If the applicant can not provide the original copy of marriage certificate, he or she shall provide a “Marriage Registration Certificate” issued by the original marriage registration office;

4) Photo: Two 2-inch bareheaded, full-face ID color-photos

6. Procedures of Registration

First review (The applicants provide valid ID cards and marriage certificates) → Acceptance (Fill in the divorce petition form and the consensual divorce agreement) → Review → Registration (Issue the divorce certificate)

7. Time Limit and Results

When the applicants have provided complete and valid documents, and the divorce agreement conforms to laws, the registration office will accept their request on the spot and issue a divorce certificate.

If the applicants do not conform to the conditions of divorce, the registration office will not accept their request for divorce, and will issue a notice of non-acceptance to them.

9. Complaints and Supervision

The registrants could report the illegal behaviors and disciplinary offence of registration authority and staffs to the Supervisory Office of Bureau of Civil Affairs of Shanghai.

Marriage (Adoption) Registry Office of Shanghai

Notes:

1. The “Consensual Divorce Agreement” shall be written in Chinese.

2. Under the following circumstances, the applicant’s request will not be accepted by the Marriage Registry Office.

1) The couple did not go through formalities of marriage registration in Chinese mainland or consulates, embassies of PRC in foreign countries, but want to go through formalities of divorce in marriage registration office in Chinese mainland;

2) Both parties are foreigners, Hong Kong, Macau and Taiwan residents, or overseas Chinese, but want to go through formalities of divorce in marriage registration office in Chinese mainland;

3) The couple went through formalities of marriage registration in Chinese mainland, but both parties have obtained legal residential qualification, long-term residency or permanent residency abroad or in Hong Kong, Macau and Taiwan;

4) After going through formalities of marriage registration in Chinese mainland, the applicant’s name, ID card information is not identical with the information on his or her marriage certificate, and can not provide written proof materials;

5) One party can not express his or her true intentions with Chinese, and no third-party is available as his or her Chinese translator;

If the applicants can not go through formalities of divorce in local marriage registration office, they could consult with the local People’s Court.

4. For Shanghai residents who have completed the procedure of marriage registration, they shall go to the police station where their registered permanent residence located in to have their marital status changed on their household registers.
