Item: Registration Procedures for Overseas Chinese, Hong Kong, Macau and Taiwan Residents to Adopt Children and Step-Children of Collateral Relatives by Blood in the Last Three Generations

Details

1. Item

Administrative confirmation on the adoptive relationship between overseas Chinese, Hong Kong, Macau and Taiwan residents (the adopters) and the children of their collateral relatives by blood in the last three generations (the adoptee) or the children of their spouses, the ex-husband or ex-wife of their spouses (the person placing out the child for adoption);

2. Legal Basis

“Adoption Law of the People’s Republic of China” (November 4, 1998)
“Rules of Registration for Chinese Citizens to Adopt Children” (May 25, 1999)
“Regulations on Jurisdiction of Overseas Chinese, Hong Kong, Macau and Taiwan Residents for Adopting Children and Certificates, Supporting Materials They Need to Provide” (May 25, 1999)

3. Conditions of Adoption

1) The couple (both the husband and the wife) shall be 30 years old or above (This item is not applicable for step parents to adopt step children);
2) The couple has no children (This item is not applicable for parents to adopt abandoned babies and children in social welfare institutions whose natural parents are unknown, step parents to adopt children, or overseas Chinese to adopt children of their collateral relatives by blood in the last three generations.)
3) The couple has the capability to bring up and educate the adoptee (This item is not applicable for step parents to adopt step children);
4) The couple does not have diseases that make them inappropriate to adopt children in medical terms (This item is not applicable for step parents to adopt step children);
5) The husband and the wife should reach a consensus on adopting children;
6) If a single man wants to adopt a female baby (child), the age difference between the adopter and the adoptee should be more than 40 years old (This item is not applicable for adopting children of his collateral relatives by blood in the last three generations);
7) The adoptee should be a juvenile under 14 years old (This item is not applicable for step parents to adopt step children or parents adopting children of his collateral relatives by blood in the last three generations);
8) Each adopter could adopt one child only. (This item is not applicable for parents to adopt abandoned babies and children in social welfare institutions whose natural parents are unknown, or step parents to adopt step children)

4. Application Materials

The adopter shall submit the following documents and certifications:

1. “Application Form of Adoption Registration” (one copy);

2. Passport and proof of residence: Hong Kong Identity Card, Mainland Travel Permit for Hong Kong Residents, Macau Identity Card, Mainland Travel Permit for Macau Residents, Taiwan Identity Card, Mainland Travel Permit for Taiwan Residents, other valid travel documents issued by the authorities of the People’s Republic of China;

3. Documents issued by the diplomatic establishments or authorized institutions of diplomatic establishments of the adopter’s home country to prove the adopter’s age, marital status, occupation, assets, state of health and criminal records. These documents shall be certified by the diplomatic establishments of the adopter’s home country and the consulates of the PRC in this country, or shall be certified by public notary offices in Hong Kong, Macau or Taiwan.

4. Adoption agreement (Step parents adopting step children, or parents adopting children of their collateral relatives by blood in the last three generations, do not need to submit this agreement.)

5. Photo: Three 2-inch photos of the adopter and the adoptee (4 x 6 cm).

As for the person placing out the child for adoption, and the child is his or her collateral relatives by blood in the last three generation, he or she shall submit the following documents and certifications:

1. “Application Form of Adoption Registration” (one copy);
2. ID card and household register;
3. Marriage certificate; (A divorced person shall submit his or her divorce certificate; a widowed person shall submit relevant certifications;)
4. Notarial certificate of kinship;
5. Agreement the person has signed with local family planning authority to prove that he or she did not violate family planning policies.

As for the person placing out the child for adoption under the circumstance of step parents adopting step children, he or she shall submit the following documents and certifications:

1. Letter of consent: The written letter of consent from the child’s biological father or mother;
2. ID card and household register;
3. Divorce certificate (the divorce certificate of the child’s biological father and mother)
4. Agreement the person has signed with local family planning authority to prove that he or she did not violate family planning policies.

The adoptee shall submit the following documents and certifications:

1. ID card and household register;
2. Birth certificate or notarial certificate of birth;
3. Letter of intent: Children above 10 years old shall submit a letter of intent showing his or her willingness to be adopted by the foster parents.

6. Procedures

Fill in the application form → Submit documents → (If a social welfare institution places out the child for adoption, the adopter shall submit the agreement he or she has signed with the social welfare institution) → Review and approval → Issue the “Adoption Registration Certificate”

7. Time Limit

The adoption registration center shall review the application form and documents within 30 days after receiving them, and issue the “Adoption Registration Certificate” to foster parents complying with the “Adoption Law of the People’s Republic of China”. The registration center will not accept the request of parents who do not comply with the “Adoption Law of the People’s Republic of China”, and will issue a written notice to them and explain the reasons of refusal.
