Item: Registration procedures for foreigners (Chinese with foreign nationality) to adopt abandoned babies and children in welfare centers for children in Shanghai

1. Item

Administrative confirmation on the registration procedures for foreigners (Chinese with foreign nationality; hereinafter refer to as “the adopter”) with the consent of the adoption center in China to adopt abandoned babies and children (hereinafter refer to as “the adoptee”) in welfare centers for children in Shanghai (hereinafter refer to as “organizations to place out for adoption”);

2. Legal Basis

“Law of Adoption of the People’s Republic of China” (November 4, 1998)
“Rules for Foreigners to Adopt Children in the People’s Republic of China” (May 25, 1999)

3. Conditions for Adoption

1) Meet the requirements of “Law of Adoption of the People’s Republic of China”;
2) The adoptive parents shall conform to the laws of their home countries, and these countries shall have signed agreements with China on adoption of children;

Note:
Countries that have signed agreements with China on adoption of children: The United States, Australia, Canada, Sweden, Finland, Iceland, France, Denmark, Ireland, Belgium, UK, New Zealand, Norway, Holland, Spain, Singapore, Italy

4. Application Materials

Foreigners who want to adopt children in China shall submit the following documents. These documents, which will be sent via the adoption center in China, shall be produced by the government or authorized adoption organizations of the adopter’s home country, and shall be notarized by the diplomatic establishments of the adopter’s home country and the consulates of the PRC in the adopter’s home country.
1) Petition for adoption;
2) Birth certificate;
3) Marital status certificate;
4) Certificates of occupation, income and assets;
5) Certificate of health check
6) Certificate of non-criminal record;
7) Certificate showing the adopter’s home country has agreed him or her to adopt children in foreign countries;
8) Report of family background (e.g. the identity of the adopter, the eligibility and appropriateness of adoption, the adopter’s family background, medical history, motivation of adoption, and qualification for taking care of children; )
9) Photo: Three 2-inch photos for the adopter and the adoptee (4 x 6 cm)

6. Procedures

The adopter sends application and provides relevant certificates to the adoption organizations in his or her home country → The adoption organizations submit application materials to the adoption center in China → Examination and approval by the adoption center in China → Issue “Adoption Notice” to Shanghai Civil Affairs Bureau → The adopter and the welfare center for children submit an “agreement of adoption” → The run-in period for the adopter and the adoptee → Shanghai Civil Affairs Bureau issues an “Registration Certificate of Adoption”

The adopter and the adoptee sign a run-in period agreement and go through formalities of adoption:
1) Both parties of adoption (the welfare center for children is the “adopter” and the “organization to place out for adoption”) sign a run-in period agreement and go through formalities of adoption. (The run-in period shall not be less than 24 hours.)
2) When the run-in period was over, and the adopter is willing to adopt the child, the “organization to place out for adoption” will go through registration formalities in the Adoption Registration Center of Shanghai Civil Affairs Bureau (The adopter shall provide his or her passport and relevant materials, such as the adoption notice issued by the adoption center in China), fill in the application form for adoption, and go through formalities of adoption after receiving the approval.

7. Time Limit

After the Adoption Registration Center received the “Adoption Notice” and relevant materials issued by the adoption center in China, it shall go through the formalities of review and adoption registration within 7 days.
